BM Unable To Be Served

Francesca's picture

Anyone have any experience in Illinois with a spouse who is unable to be served divorce?

BM has been hiding in the house and telling kids and mother not to open door.
Sheriff and special deputy have been attempting to serve for 8 weeks.

Now SO's lawyer must return to court to ask for another extension (alias summons). Each is good for 30 days.
She can be served by publication but that has no jurisdiction over custody of children. Lawyer does not recommend it. Any advice?

Can she be subpoenaed to court for service? Now we have given lawyer DETAILED times and locations where she might be (kids school, etc.).

WTF?

Get someone to call her and tell her she has won ticket to her fav band. And she has to pick them up at xxx address. Snap!

I am sorry about all of this hassle for yuou. But even if she is a troll she will eventually have to show her face.

Interesting. I lived in Texas the last few years and while there I lived in an apartment complex. One day I saw that my neighbor had a HUGE envelope on her doorstep and it was about to rain...and her apt was where the hall always flooded...I picked up the big envelope thinking I could put it through her door or something and it was "DIVORCE PAPERS" yikes...I quickly put them back on the floor...so, I wonder if they know where she lives, why they can't just leave them there.

We had to have BM#1 evicted from a home that DH was renting to her (ugh long story there) and in NY after you make so many attempts to serve notice and you document those attempts, you can just leave the notice and consider them served.

It doesn't seem right that someone can avoid legal matters by refusing to answer the door/leave the house.
