So a few weeks ago I posted about our CS possibly being terminated because my SD16 has been living with us for over a year. Well, today the tables FINALLY turned in our favor! CS was terminated AND we found out that she has started receiving disability. Including benefits for the child that is NOT living with her...to the tune of over $700/mo! So my fiancé informed the local social security office and they said those benefits will now be coming to him since the child lives with him, which we totally didn't expect! He just didn't want her receiving $ for him when she doesn't care for him. We were happy with just getting CS dropped. We agreed that we are going to put the $ from the benefits into a savings account for him for college. The woman said we could even sue her for the $13K she got just for him in back pay but Im sure thats not as easy as it sounds. Either way, the day has come where we are done getting screwed over.

I honestly don't even know what her disabilty is and how in the world she's getting almost $4K/month!! Makes me sick that my father who is 69 and worked his entire life was denied for unemployment for being honest and doing the paperwork correctly and here she is collecting almost $4K per month on disability. And I know some people's disability isn't physical but when you just got a felony for delivering drugs and can go party all weekend drinking while you're on probation - the sympathy tends to run dry.

Don't get me started about people receiving disability when they shouldn't.

I darn sure would sure for that $13k in back pay! They may take it out of her 4k a month

I would also sue for that 13K, and I am not a litigious person, but that was fraud and just plain wrong.

Check into how reclaiming may take place. Basically she received it by fraudulent means. If the gov't gives, the gov't can retake. Meaning they would subtract x amount from her ongoing disability until repaid. Example, if she will now be getting xx a month , they can take x out of it to repay her 'illegal' past checks.

If it's a matter of your husband claiming thru their office what's being paid back and child getting it by way of higher monthly checks (his normal plus basically garnishment interception from BM's check), I'd go for it.
