So just found out that BP has pending disability claim? What happens now? Can I get anything from disability for the child?

The child will get a monthly check from Social Security.  The check will go to and adult to used that Money for the child.  That the legal person who has control of that child

Yes .  A CS order with direct withholding will come out if a disability check just as it will come out of a paycheck.

Disability does count as income and will be used in the state calculator just like it is a job.

If his disability claim is granted and it becomes income then you can file for an ammendment of CS and garnish that income with direct payroll withholding of CS.

At least that is how I understand it to work.

Rags is correct. You need to do a child support modification hearing. Don't worry about a lawyer- just file. Have your income, he will have to provide his. They run the numbers and it is over. Many times it is all done with the mediator outside the  court room, then you go in and the judge orders what was found. Usually quick and painless.

And until the Bio-parent is collecting, there is nothing that can be done for CS.
