Just dropped off the court papers for the coonstructive emancipation of SD19 and downward mod for YSS stb 15!

Boy does THAT feel good!!

Question - is the downward mod just because SD19 will be emancipated or did you request the downward mod for another reason?

And yes, I'm sure your DH will now be the most deadbeat dad ever for not wanting to continue to support Girhippo's lifestyle. My DH has already told BM repeatedly that he's happy to provide for his children, but he would rather pay for things directly than give her any money.

It bothers me that there are no checks and balances that ensure that child support is actually spent supporting the child. Ex spouses should bear no responsibility for supporting one another. They are both adults and this day and age, both should be equally capable of supporting themselves financially.

I'd be more than happy to give my ex an itemized list of what we spend on DS. Of course, ex knows that DS is in college driving nearly an hour each way and not working so gas and insurance alone probably eats that up.

Right!

Ya, he was going to get an apartment but now he doesn't seem to want to. Most people in my area have to drive an hour for decent jobs. We are really rural.

I don't necessarily hunk it's my business, but do think it's DH's business, especially since he gets requests for more money to cover things that should be covered by child support.

MINE TOO. BM's loans she took out in his name while he was deployed that she's supposed to be paying 50% of. It sucks!

thinkthrice's picture

It was that way with Chef for many years until he finally realized he was being ripped off. It took him a little over a decade Lol

ProbablyAlreadyInsane's picture

Well we've already lost over $10k in the last year and a halfish to it... So idk how much more we have to lose before he finally realizes that... Sad

Guilty daddy is the gift that keeps on giving. Chef voluntarily over paid CS w/o a CO in place. Took over 10 years for him to see my point.

I understand we may not see where every penny goes. After all food, housing, and bills are apart of raising a kid. There's school supplies and lunches and all sorts of ways it can be spent that we may not see directly.

But yeah when SO's son is sent to us crying because his feet hurt in shoes that are 3 sizes too small but BM has enough to go out and party I start calling fowl.

This is where DH shouldn't have to fight to show he's the better parent.

DH and I just had this discussion about skids. We're frightened to tally up the amount of CS that DH paid, along with the SSDI that skids got from ages 10-18, along with all "extra" that DH got roped in to and guess what? At ages 19 and 20 they have absolutely freaking NOTHING to show for it. BMs never saved a penny, skids never saved a penny, they have NOTHING!

How do you do that to your kid??

thinkthrice's picture

yep. I estimated it would be between a third to a half million dollars when all is said and done. Meanwhile skids have no career and no goals in school other than to perhaps live with the Girhippo -n- StepDaddyBigBucks in her basement until their 40s. I'm pretty sure StepDaddyBigBucks wants to see them out.

Funny thing was when we ended CS for OSS as he accidentally emancipated himself, she did not have him move back in when the gravy train dried up.

Both Chef and the Girhippo took a pay cut. The Girhippo quit her job as a CPS worker/supervisor (ironic as she is one of the worst parents I've ever met) to artificially lower her income and try to get SD into Community College for free.

She now works as a waitress in a local casino but her taxes should reflect that she was making pretty big bucks as a caseworker supervisor and ditched it all for "unknown reasons."

Hope you get a ruling in your favor. And I hope Chef appreciates what you do for him. he'd be living in a cardboard box if it weren't for you.

I guess I missed some blogs, but did the registrar ever get back with Chef --- he claims her on income tax and in NY that gives him authority for verification, correct? That entire situation stinks. (Refusing to provide minimal verification of college; no mention of schooling on FB and the obvious obfuscation ... argh.)

Good luck. I'll be keeping an eye peeled your direction because I definitely anticipate some fireworks.

thinkthrice's picture

Nope the registrar went to radio silence when he found out it was a PASout situation.

This will not go down quietly. Keep us posted for our vicarious reading entertainment. Chef is darned lucky you've chosen to keep hanging out with him.

thinkthrice's picture

he actually gave me this very sweet card for my birthday... basically stating that I am wonderful to put up with all the bullshit!

thinkthrice's picture

Thanks wineisthecure but I'm quite sure this will be dragged through the courts for at least another year and will not be retroactive if past track records are any indication.

It took almost a year (with both attorneys involved) to get OSS emancipated despite clear evidence that he had left the Girhippo's house (and that the Girhippo had no intention of sharing that information with Chef) and was living with a paternal uncle--of course it was not retroactive CS wise. The Girhippo got to keep the entire amount of CS during the Emancipation proceedings so it's in her best interest to drag it out. Good old BM Centric New York State!!

Yes the child support enforcement units get kickbacks from the federal government under the Social Security Act for the highest amount collected; there is no incentive to downward modify for the local enforcement units

thinkthrice's picture

yep...and NCP biodad has to pay the admin fee for the "privilege" of having his pay confiscated.

I just still don't understand where this idea that parents should pay for college came from.

I like SO's agreement. He pays till the kids are 18 or if still in highschool it continues as long as they are in school. The only problem I see with this is if they are repeatedly redoing grades but most times the school doesn't allow that so he should be good.

It also clearly states that as soon as his oldest meets these conditions the amount cuts down to what it would be for just one kid. Sure she could try to go cry to the court but it's in black and white.
