Court Date Granted

For downward mod on 1/8. Frankly I'm scared shitless. Chef's attorney seems to think he can "go it alone" for the first court date (because there's always another one).

The Girhippo will no doubt show up with her pitbull attorney on the first court appearance.

Chef's attorney also thinks that constructive emancipation will not be granted for SD (yep, we knew that but they say ask for more than you think you'll get) seeing that SD19 is enrolled in community college (and failing out)

Either way, because the Gir has artificially lowered her income and Chef has had quite a decrease as well (over 15%) that his CS, worse case scenario *should* go down by $74 a week.

Chef does NOT verbally express himself well and that is my concern. Especially not in a court setting. Chef's attorney said that the magistrate will ask "have you come to an agreement?" (which is dumb because this is just preliminary finding of fact) at which point both parties answer "no" and another date is set.

Ugh...she's 19 and you're still going through this? When she fails out of community college will his c.s. obligations end? In my state when I divorced, c.s. ended at age 18 or graduating high school, regardless of college. Is he paying for her college as well?

Not the way the current CO is written (by a lopsided mediator who told Chef he should probably get an attorney--which he ignored--wanted to "get it all over and done with as fast as possible" (TM)

IOW would agree to any of her demands in order to end the marriage.

CS goes to 21 here in NYS, but we want grade stipulations and for CS to stop if she goes on academic probation (which she will).

SD19 is also PASed out beyond belief and has refused to see Chef for nine years and counting now--thus the Constructive Emancipation by Conduct.
