Tax question!

Okay so the CS order states BM claims SD on her taxes every year. They went back to court for a modification because she stopped working. She has zero income so they raised his child support. (I know. Fucked up. Whatever)

Anyway. The tax thing was never discussed. It was just kept the same in the papers. Dh and his attorney didn't think of mentioning it.

So BM has no job. She gets financial aid for schooling but that's all that I know of.
She's not married but her BF pays all the bills.

So who claims SD then? Idk how the financial aid works and since she doesn't have a job, I assume her BF claims her (BM) on his taxes? So does he claim SD too? Is that allowed?

Should we even bother or ask BM who is claiming SD on their Taxes or ask if DH can?

Ugh. I hate that they didn't discuss/address this at court. Dh is always pushing away my suggestions or saying he doesn't need my help when it came to that stuff but he always half asses it or doesn't think about things fully.

Ugh! This should have been addressed because with your DH paying all the support since BM's income is zero, he should get to claim her. He needs to bring this up with his lawyer since lawyer dropped the ball.

BM could voluntarily sign form 8322, which would allow your DH to claim SD, but would she? If your DH just told her, "Since I pay all the child support, you need to sign this," would she do it?

Frustrating.

lol. No. She wouldn't. I would have a heart attack if she did but I'm sure she won't. Like 200% sure.
