Going to court what do we need to do

butterfly's picture

We are going to court later this month. I hope it all goes well am very nervous. We are the ones who are wanting more regular visitation. She didn't respond to the order and we go to court next week.( she regualy with holds visitation for stupid reasons)

My Fh has 5 days on five days off and we are asking to have them two days of every break. preferably the first two days off so they know when they are comming and so bm cant with hold access when ever she feels like it. they are 5 and 3. My fh wants to be apart of there lives not just as a fun time dad. So we will be responsible to meet there needs school, excetra.

What I want to know is should I be there on court to show my support as we are getting married in january. She is in a live in relationship herself so if she shows it is possible that her partner will be there. also my fh is representing himself she has legal aid so i find it hard to fathem would track she is taking not responding to the order.

With my fh representing him self do you think we will need affidavids (however you spell it) from our family saying that they support us and
so fouth . What happens if she dosn't show will it mean more times in court. She signed recieving the papers.

Any help or advice appreciated.

I would take a bunch of character witnesses if I were DH. As for your attendance, I believe you should attend. However, there are several comunity members including family law professionals that believe that the presence of an SO at a Custody/Visitation/Support hearing irritates the judge.

Good luck and best regards,

As the SO, I think you should be there to support your FDH. However, you'll want to keep your mouth shut unless asked a question by the judge directly. I would also advise your FDH to take any proof of her denying visitation, mainly emails or text messages, to prove his point in needing a better agreement.

I agree with Rags - a few folks to vouch for him couldn't hurt.

Good luck!
