Question about child support

Just curious - once children become emancipated, what happens with cs that's in arrears? Does cs agency keep collecting and sending to the custodial parent?

In my state, yes. I have a friend who's 37 and his mom is still getting support for him. It's taken out of his dad's disability.

If they don't pay arrears before they start collecting social security, social security will take a significant chunk out of each month's check to pay it back.

I also just saw an inheritance where the heir had to pay child support first. It was only like $500 so I imagine the guy was only a month behind or so but child support got it.

Do you know if there is a check for that? Sadly I feel like that is the only way I will get the back child support owed to me is if Ex's mother leaves him $ when she passes away.

I don't know how CSE knew, I really don't. We process cases through probate and we don't call CSE to see if any of the heirs owe child support. I don't know how they would find out.

If I were you, I'd keep my ear to the ground and keep tabs on anyone dying. My ex owes like $35K and his mom and stepdad have a ton of money. They have already said they want to leave some to my DD, though. However, I can pretty much guarantee they have left DD's father out of their wills. He's a real POS. In jail at the moment.

My ex's social security number was red flagged when he fell behind in CS. He could not get anything in his name, any lottery or inheritance or taxes refunds came directly to me. I got his tax refund for 5 years.

But how would they know about his inheritance, I don't think we put social security numbers of the heirs into the system. I can see how tax refunds could be caught. I don't know a thing about lottery winnings.

Weird. The case I saw wasn't in my office so I don't know how they knew. Maybe the guy was honest about it. He still got a few thousand after that.

My SM, SD, and dad still get back CS every once in a blue moon for grown children. Ridiculous amounts. $5 here and $10 there.

The only instance I've heard of or experienced where the CS arrears were wiped away was when DS's BD died. He died on a Saturday and by Tuesday I had a letter from the CS office that the CS amount owed was $0 and the case was closed. He was behind by just under $20,000 when he died. They didn't wait for final taxes to be filed or anything. They closed it right then and there.

Not exactly sure but I think its a lot. Thousands. I know what they take from his pay covers current cs and then some towards arrears. Plus any tax refunds get taken
