Mom agreed to a consent order to have kid vaccinated. Didn't do it. Dad filed a motion for a show cause hearing. Mom tried every stupid argument under the sun. Judge didn't buy it. Mom never asked for reconsideration, never filed an objection.

Cutter's picture

From what I understand is that dad originally agreed to a delayed vaccination schedule right? I don't understand why dad didn't find out what he needed and take him to another dr and get it done himself.

moving_on_again's picture

I'm going to make the assumption that wasn't the case considering the only way the judge would know about it is if dad took her back for contempt.

Cutter's picture

When they were together and first split dad agreed to the delayed vaccination schedule. For whatever reason he changed his mind. Why didn't he just take the kid and have him vaccinated?

moving_on_again's picture

I am sure dad was worried he would get in "trouble." Better to have a judge say it has to be done.

Cutter's picture

If he was this concerned about making sure his kid was safe then getting your hand smacked by the judge is nothing. Plus he has as much rights as mom does so who is to say he wasn't allowed to get his kid his vaccines like parents do every day? i think these 2 love to fight.

WalkOnBy's picture

Ummm - he didn't get his hand smacked.

SHE was the one ordered to do it.

SHE didn't do it.

I think you like to make stuff up...

WalkOnBy's picture

The court order said mom was the one to do it. No reason for him to think that she wouldn't, since it was a consent agreement.

Then, when she didn't, dad followed the proper legal course, instead of just taking matters into his own hands.

One thing that was only briefly mentioned - mom changed the kid's school without dad's consent. there are lots of things that mom did unilaterally that she shouldn't have done.

This chick better get it together or she is going to lose custody of those kids. It hasn't taken this judge very long to figure out that this broad is a BM who thinks she doesn't have to obey orders of the court.

Medusa learned the hard way - here's hoping this woman doesn't have to.

WTF...REALLY's picture

He probably didn’t want to do it himself because the mom is constantly badmouth thing him to their son. So he didn’t want to be the one to not go get thim shots and the mom tiell thier son how horrible and evil the dad is for doing that. She’s not coparenting in the slightest with the man she made a baby with. She’s making decisions as if she’s the only parent.

WalkOnBy's picture

the issue is that mom and dad agreed to the consent order. She has had 10 months to comply with the order.

Like Medusa, she was told she could go to jail for contempt. She chose to not comply. Listening to the hearing this morning was rather interesting.

Why mom agreed or why dad changed his mind, if he indeed do that, is not relevant.

She agreed, she signed, she didn't comply, she is now sitting in jail for 7 days and dad has custody until such time as the order has been effectuated.

Cutter's picture

I wonder why dad just didn't take him. It's not like the judge can undo the vaccine and it was agreed upon that the kid would get it. They both sound like they like fighting with each other.

WalkOnBy's picture

because he was waiting on mom to do it. She said she would, then came up with every excuse under the sun. The order said mom was to have it done.

Dad was following the order as it was written.

Thumper's picture

Really Cutter?

"They both sound like they like fighting with each other?

This JUDGE was sure to note on record moms unilateral decisions AND also This Judge on record told this mom that the child has TWO PARENTS.

Maybe, just maybe you didn't have the time to watch the video in it's entirety.

Unfortunately a custodial parenting erasing the other parent is NOT uncommon. Glad this Judge used her authority fairly in her sanctions.. Hope Mom understands dad is just as important.

OR she may loose custody long term.

thinkthrice's picture

bout time these judges realized that just because you popped one out doesn't make you MOTY.

WalkOnBy's picture

Yup!!

WalkOnBy's picture

it was dad Smile

I LOVE that she got it and that she repeatedly said this wasn't about vaccination, it was about enforcing the consent order to which SHE agreed Smile

WalkOnBy's picture

watching the hearing in real time was fascinating. The parties came in and mom's attorney tried to argue that she hadn't received proper notice. Judge reminded him that proper notice was provided. Then he tried to argue that she didn't know that she could go to jail.

Judge read back transcript of the previous hearing where she told mom in no uncertain terms that jail was on the table.

Then he started up with she didn't know what she was agreeing to. Judge told him that she absolutely did and then reminded him that the consent agreement had actually been modified so yeah, she understood it.

Attorney asked for a break so he could talk to his client. They went out in the hallway for about 20 minutes and when they recalled the case, she said she was going to plead guilty.

Then all the stuff that is in the video clip took place.

WalkOnBy's picture

not really - he was just doing his best with the stupid arguments he had. He was just doing his job.

moving_on_again's picture

He should know the judge is going to knock all those arguments down so why even bring them up.

ETA - Makes me wonder if mom got a new lawyer because the original one probably told her she was screwed and he didn't know what happened in court.

This is BM's MO. She never uses the same lawyer twice because she 1. doesn't pay them 2. she lies. Then the lawyer looks likes an idiot in court when repeating her lies.

WalkOnBy's picture

yes there were a few attorneys, but all lawyers make the arguments they can for their clients, even if they are perhaps not the best ones to make Smile

moving_on_again's picture

And there are attorneys that take people's money when they know they don't have a case. Drives me batty. We turn away clients like that.

WalkOnBy's picture

Meh - I don't think he's a bad attorney. I know I have worked on very legitimate cases that didn't have super great defenses.

I am impressed that while he had mom out in the hall, he got her to agree to plead guilty. I was very surprised when she walked back in and said she would.

WTF...REALLY's picture

I thought he did a good job of defending her. He tried every avenue he could think of and that’s what she paid him for. He definitely did his best given circumstances.

queensway's picture

He did look bad. But most attorneys are snakes and only care about making money in cases like these. The more money they rack up the better for them.

WTF...REALLY's picture

I have to say this cracked me up. It’s a rare court actually follow through when another parent does not follow a court order.

And as a reminder. Everybody vaccinate your children! Smile

WalkOnBy's picture

I wonder if Medusa would agree to that now that she experienced it first hand??

Thumper's picture

Did anyone notice right before mom was handcuffed, Mom tried to open up another dialogue with the Judge? The Judge wouldn't allow it.

What do YOU think she wanted to say to the Judge?

1. Do I still get my child support?

2. Your honor my child doesn't have a bond/relationship with dad. YOU CANT give him temporary custody.

3. Your honor cant my child stay with my parents? HE is very scared of his dad.

4. Your Honor, will you order my ex-husband to accept my collect calls from jail?

5. Do I have to pay him child support?

6. Do I have to give back my child support this week?

queensway's picture

I find this whole story to be sad for the child. Why didn't the father take the child to get his shots? Why didn't the court order that? Why are 2 parents at such a low level in parenting this child they turn to the courts? The judicial system in this country is substandard when dealing with matters like this. So now the mother goes to jail for 7 days. Does this judge think all is going to be fine with this child's family? This judge could care less. Because the mother is going to jail things are going to be worse for this child. These parents are going to fight even more. This mother is now going to tell this child Daddy put me in jail because I was trying to protect you. And the saga goes on and on. To the judge this case is just a number but hey the child will get his shots. All is well in the courtroom. And if the father is doing this to get back at the mother he is one happy Daddy right now. So in the end who really wins. It should have never gotten to this point.

WalkOnBy's picture

Why didn't the father take the child to get his shots?

-because mom was the one who was ordered to.

Why didn't the court order that?

-because that isn't what the parents agreed to.

Why are 2 parents at such a low level in parenting this child they turn to the courts?

-Dad turned to the court because mom agreed to do something and then didn't do it.

The judicial system in this country is substandard when dealing with matters like this. So now the mother goes to jail for 7 days.

-If mom didn't want to go to jail, then she should have followed the order.

Does this judge think all is going to be fine with this child's family? This judge could care less. Because the mother is going to jail things are going to be worse for this child.

-Dad will have custody of the kid until the vaccines are done. Dads are perfectly capable of parenting.

These parents are going to fight even more. This mother is now going to tell this child Daddy put me in jail because I was trying to protect you. And the saga goes on and on.

-you are probably right, but that doesn't mean that dad has to bow to that...

To the judge this case is just a number but hey the child will get his shots. All is well in the courtroom.

-No, to the Judge this case is like any other case where a litigant is ordered to do something and gets sanctioned for not doing it.

And if the father is doing this to get back at the mother he is one happy Daddy right now.

-He isn't doing it to get back at her.

So in the end who really wins. It should have never gotten to this point.

-That I will agree with. But it was ALL in mom's control.

PS = you sound a lot like Medusa

queensway's picture

Sad Still is a very sad story for a child. He will find out about it one day. I am not into blame of which parent is wrong or right. Just feel for the child.

notsobad's picture

Yes, it is very sad for the child.
Just how would you suggest it be stopped?

Should Dad and the courts continue to allow BM to do whatever she wants? To what end? Will the kid turn out to be happy and well adjusted if BM keeps getting what she wants and is never held accountable?

That's one of the Major complaints on this board, Dad does nothing, BM and skids call all the shots.

Standing up and doing what's right for the kid is what needs to happen. In this case it means BM goes to jail for not following a court order. The skid learns that when you are told by the courts to do something you do it. Life lessons are sometimes painful but they need to be learned.

moving_on_again's picture

You're right, it shouldn't have gotten to this point. If the mother just did what she was supposed to, it wouldn't have. Not sending people to jail for stuff like this is the reason they keep doing it.

queensway's picture

You are so very very right. She should have listened to her ex husband when he said I am going to court. She should have let the husband take the child to the doctor. It is called parenting the child and doing what is right for the child.

advice.only2's picture

I like judge Karen she rocks!

And on a side note I agree please vaccinate your kids. I have zero immunity to measles, I had it twice as a kid and have been given the inoculation twice as an adult only to show I still have zero immunity to it...so for people in my shoes, having a kid be vaccinated not only protects them, but it also protects people like me. Just my PSA for the day.

WalkOnBy's picture

Asshat and I were out of family court by the time she was elected.

All the cool judges (Gorcyca, McDonald) came after Asshat and I got out.

Though we did have a female judge at the tail end of our silliness and she was awesome!!

notsobad's picture

On a side note, I hate anti-vacxxers.

I do not want to high jack this post or start a debate. I just want to state that I intensely dislike people who think that they know better than trained medical professionals.

WalkOnBy's picture

I just spent a ton of time looking at the docket in this case.

Holy hell - GUBM here for sure

Case started in a different county and was moved to Oakland County.

frivolous motions - check

attorneys filing motions to get out? check

multiple allegations of abuse? check

multiple allegations against the new wife? check

Blah - these poor kids Sad

SugarSpice's picture

society needs to wake up and see that just because a woman slept with a man and had his child does not make her a fit parent.

WalkOnBy's picture

You should see all the comments on the video clip, Aniki. All blaming the Judge and a whole bunch of WHY IS THE GUBERNMENT TRYNA TELL ME WHAT TO DO

Hardly any of the comments were related to the story OR the video, but whatever Sad

Aniki-Moderator's picture

Alas, WOB, I cannot view videos at work. But I have an excellent imagination!!

My nephew's exW almost got sent to jail for pulling a bunch of stupid crap. Freaked her out and she's been veeeeery good ever since. }:)
