WTF?!?

DH hasn't owed CS in forever... the "kids" are "adults." (LOL.)

He's never been in arrears. Ever. BM went to court a year AFTER SD graduated HS and got an order for bullshit medical. (Birth control and therapy and bullshit.)

DH has to pay it. Ok, fine. The hearing was by phone in the middle of our out of state move. Within a couple of weeks, they had taken the f'n $$$ out of our checking account. Ok, first of all, we hadn't even GOTTEN a copy of the damn order yet, and they were garnishing our bank account, but whatever...

They took the $$ IN FULL back in AUGUST. (This is important.)

My DH just got a new job and will receive his *first* employment check next week. Seems CSE already sent a wage withholding order to his *new* employer to withhold the money!!

First of all, when you pay everything you're supposed to when you're supposed to, it SUCKS being treated like a deadbeat asshole and having your wages/accounts garnished. Now, his new employer will have him in their system as such. PUKE.

But the kicker?!?

WHY THE F ARE THE WITHHOLDING WHEN IT'S BEEN PAID? SINCE AUGUST?!? WTF?!?!? I called, and they wouldn't "really" talk to me, but basically said that the money hasn't been posted to his account and they're required "by law" to withhold it.

OMFG I am SOOOO pissed!!!

It's not even really about the money... it will *eventually* come back to us (I think) but the whole thing is SUCH BULLSHIT!!

And, YES, this is the same CSE that hasn't and can't collect a penny of the $100K my XH owes ME. Rather irritating.

OMG that is such crap!!! Isn't it so frustrating when you are pissed about something and want to get to the bottom of it and they can't talk to you about it!! Nothing aggravates me more!! Sometimes I wish I could put on a man voice and be DH on the phone.

If it was paid in August what the heck did they do with the money that its not posted yet!! Where is it?? I hate shit like this. I wouldn't sleep until its resolved.

GRRRRRRRRRRRRRRR I'd be livid too. I just don't understand how that system works. If the full amount has been paid off for 4 months now, he's done right? There's NO need for a withholding order!

Yeah, both of his little darlings are "of age."

It's only about $1000 so I really don't want to waste $$ on an attorney, but I'm pretty pissed.

I think I'm more pissed about the wage garishment like he's a garden variety deadbeat dad!!! He is SO not one of those... almost to the other extreme.

I just want to rant and rave and drink.

Instead, I have to f'n work on a thesis...sitting in a library like a NERD!!!

I have a similar issue. It seems like when BM would fart, CSE would be there trying to get more cash for her (NOT the skids. I have proof).

But yet my DS is 22 years old and his father owes over $15,000 in arrears still and it is like pulling TEETH to get anything out of them about THAT case!

They did a report in the newspaper and people flat out said that they work more on the "easy" cases and less on the "difficult" cases.

So, what that means to me is that since my DH was never in significant arrears and keeps a steady job, BM gets the bonus of them hounding him every waking hour (ok, exaggeration but not much!). And since my son's "father" took off out of state and would quit jobs to avoid paying, then they don't have time to work on the case.

I told CSE where my son's father was living AND working when he was only 4 years old. They STILL didn't get a CO for CS in place until my son was almost TEN.

I swear if the old saying "What goes around comes around" DOESN'T happen in the situation with my BF and his loser gold digging XW I am ready to curse God and die (you know what I mean)!!!

I am just SO BEYOND fed the fuck up with seemingly everyone on this site getting fucked by a loser BM or their XH/XBF and they and their DH/SO get fucked left & right!!!

I've fucking had it with our so-called legal/justice system fucking the "good guy" and the REAL offender getting away with murder!!!!

Yea that totally blows. I'm so sorry that's happened to you. Your DH is going to have to stay on it to make sure you get it back. If they took it out they should know where it is....

CSE here was trying to tell DH that only the custody PART of the order was abated and that he still owed CS. How pray tell do you abate PART of the order? It's all one order in OK where he's from. Luckily, BM still owes DH nearly 20,000.00 so we used that to make her CS claim go away (If you continue to pursue this I'll sue you for the 20 grand). Not only did she drop the case for the arrearages, she agreed to the order that they each will pay for SS's expenses when he's with the respective parent. She's mad right now because all her white trash friends want their kids to play lacrosse together but DH isn't going to cough up 450.00 for new protective gear and she can't do anything about it because the new CO says that if DH says he's unable to do it, or no agreement is reached and she does it anyway...she's solely responsible for all associated costs...that was courtesy of ME. She's always doing stuff and telling DH later that he has to pay for this that or the other for SS. AND DH would do it. So I put a stop to that.

I effin hate stupid golden uterus BMs.

Good luck ever getting it back once it's been withheld. Won't happen. CSE has absolutely NO interest in fixing their mistakes. I've had several clients deal with that and they NEVER try to get the money refunded or returned to the rightful party.

Yup. Most likely they'll take the money regardless of your protests and PROOF of payment, and put it right into BM's account.

After they've taken the money, CSE will then refuse to help again, or at least take their sweet ass time in getting you the paperwork proving the overpayment, and then your only recourse will be small claims.

And then Good F-ing luck getting BM to pay the judgment on her own freewill. Forget about establishing a garnishment if she's anything like the account-closing, welfare-lifer BM over here.

In my case, the hearing was the second week of July. A judge (apparently) issued the order (we were told he would mail his ruling) and the money was taken from our bank account the first week of August. We had not even received the ruling at that time.

I'm rather surprised that you are fiercely grabbing hold of stupidity. You don't have ANY idea what you're talking about.

Actually, it's not surprising. It's entertaining!!

First, my DH isn't lying to me...it's not who he is, AND I was present for the telephonic hearings. And *I* am the one who communicates with CSE on his case.

Anyway, the wage assignments/accounts liens, etc, are EASY to do when he gives them the info...

Ah, nevermind. The ignorance isn't my husband's. }:)

I once heard a judge say that when a child has aged out of child support, the payor should bring an ex parte motion for termination of support. Supporting documents would be prior orders, birth certificates and evidence that child support has been paid to date.

If it were me, I would bring the motion prior to age 18 (or whatever) with an order prepared terminating child support effective such and such a date for the judge to sign at the hearing. Then get a certified copy of it and take it to the payor's HR dept. right away. In fact, hand deliver one and mail another. HR depts. can be really slow to act on termination orders. It might even be a good idea to speak to the HR dept. and see exactly what the dept. requires in an order to cease the withhold and when they need to get it.
Certainly no one should have a wage garnishment under an invalid order

The issue of child support is so critical that the federal government compensates the commissioners dedicated to handling these cases instead of cash-strapped counties compensating them. Every custodial parent should receive what is due to diminish the widespread tragedy of childhood poverty.
