DH has had joint legal custody and sole physical with visitation for BM since 2008.... Recently we modified and were granted sole custody and the judge decided to give BM suspended visitation... (we had asked for supervised)... BM texted me to ask "Under what circumstance was this granted"...mind you she didnt show up to court when the order was granted...so she only found out when I responded to her text to tell her she could not pick up SS13 Background... In Sept 2010 BM was arrested for 17 second degree forgery charges and 9 sixth degree larceny charges... stemming from a 6mo period where she robbed her employer of about 12K... using a stolen debit card and checks (she was facing 90day in jail and 5yr probabtion... on a 10yr sentence).. Somewhere in here there is another larceny arrest In Dec 2010 BM was arrested for 2 counts of leaving a child under 11 unsupervised in a vehicle... because she decided to leave her 3 and 6yr old in the car while she shopped in walmart In Feb 2011 she was arrested for attacking her sister... there is currently a warrant for her arrest for FTA... In Oct 2011 She was arrested for driving with a suspended drivers license... she was also re-arrested recently in this case on a FTA warrant because she didnt show up to her last court date. In Nov 2011 She was picked up for above noted FTA and arrested for Possession of illegal narcotics. (mostly pain pills etc... you know.. the "stuff" she needs for her back injury In Jan 2011 she was arrested for larceny and burglary for breaking into a family members house and stealing jewlery... So can anyone here help me in stringing together for her "under what circumstances" a judge would strip her of custody and visitation.... what a fucken ass...

Oh for Pete's sake.

Tell her to go to the courthouse and request a copy of the court order. If she can't be bothered to show up in court, she may have missed her opportunity for an explanation as to "what circumstances" this was granted.

She sounds like a real prize.

Agree with others, it's not your responsibility to explain to her why the court granted it. She can ask her lawyer or the other suggested sources above.

So her rights have not been removed? Bm just has no visitation, supervised or any other way? Our BM has supervised visits and she had found ways around them, like going to school activites and sporting activies. We are going to talk to a lawyer Mon. to have the papers change so that there is not away around the supervised visits. We have not heard of suspending visits. We were not sure taking BM rights away was a good thing or not. Dh doesn't want to have to explain that to SS in the future. I would like to know more about if you have time to PM me thanks.

I would just give her the address for the court clerk and tell her to call for the CO and her rap sheet so she will gain a firm understanding of why she has lost custody, etc....
