Talk to me about arrears

DH is in arrears of 30k, we just got the civil summons the other day as the state of FL just transferred it up to our state. I'm freaking out. DH has liver cancer, just had surgery and there's no way he can work. We just cannot pay. What can we do?

Oh my...I am so very sorry for what you are going through. I wish I could say that something could be done, but honestly, it seems that the courts don't much care when the NCP is sick, only when the CP is sick. Honestly, the only thing I would try to do is get a loan, pay off the CS arreages (I know, it's a bit hard to get a loan when the CS aholes put that on your credit report)...but at least, it will give you some peace of mind that he won't be constantly harassed by CSE and that is worth doing whatever you can to get them off your back. Now, if he can't work right now, then you need to make sure that you check your state laws to get CS lowered if that can be done.

Good luck...my thoughts are with you. I can't imagine how hard all of this must be on both of you.

State's are assholes about arreages, but i would DEF make sure that you get that support lowered. DH has had a change in circumstance so there should be no reason it is lowered. I know for Michigan, you have to have the "new income" for 12 weeks before you can file for an adjustment/review.

Plus, usually they tack on an extra 10-20 dollars to pay off the arreages. (at least here anyway) but with that large of an amount obviously it would take a long time to pay it off. in the mean time they will still report it to the credit bureau, and more than likely take any state refunds, maybe federal too, i dunno.

his credit is more than likely already fucked, so what else are they going to do, take away his birthday?? i would just make sure the home is in your name only, that way a lien can never be placed against it (not sure if they can do that over cs or not, but i would be safer than sorry). they may take away his drivers license (that's a tactic they use in some states) and any technical license, but he can't work anyway so who cares?

i wouldn't worry about it, there is nothing they can do to you. and i can't imagine dh being jailed in his condition. work out a $25 month payment plan or something.
