ok....big problem here...BM is having another fit over $$$....My husband has custody of his son.....he lives w/ us (moved in over the summer), so when we went to H&R block to do our taxes...they put down 2 for dependents: my SS, and our baby who was born in Oct....because they "live in our household"....well, BM wrote nasty e-mail and claims that we stole her tax return & the IRS is "on to us"...whatever....we have not even recieved our $$ yet...the IRS was holding it because of child support issues...and we got that all cleared up...we even spoke to the IRS in the process. BM claimed SS on her taxes as a dependent also...so I guess now she's in trouble...how do u claim a child that does not live with u ??? We had our taxes done by a professional...But BM claimes that we are in trouble?? Any one ever go thru this??? It's nuts....and has started WW 3. Meshel

the majority of the time living with you than you are entitled to the taxes. You can list your child as a dependant if they don't live with you as long as the parent they live with signs a waiver giving you permission to do so and states they won't be claiming the kid. This is the case here so she's in the wrong

thank you....I thought that was the case....just checking because I know I will need ammo. for later...BM & her dumb A husband are raging over this....what I wonder is what the IRS will do to them because of this ?? meshel

I would doublecheck the legal documents, though, to make sure it's not stipulcated that she gets to claim him. In my divorce, it's written in there that only I can claim my son for tax purposes. With my husband, it's stated that only his ex-wife can claim the children. If it's not written in the legal documents anywhere that she gets to claim him, then you have no worries. She, however, might have a BIG one!
