Oh the tangled webs BM weaves! (long)

So we go to court Friday for a bill of review. Basically, BM is trying to get a new trial since she didn't bother to show up for the first one and lost custody.

This is her last resort at a new trial. Her first was when she filed a motion for a new trial and was denied back in October. Our lawyer said that he doesn't feel she has much of chance with the bill of review because she has to show she was not neglegent in anyway concerning the original ruling. Well, not showing up or even contacting the court after being served BY HAND IN PERSON by a sheriff's deputy gives no room for her to deny neglicence on her part, he feels.

Also, I told the lawyer that we have to do something about child support. FH is still accuring arreages although he's had custody because we haven't yet moved forward with it. It's now up to $19,000. I think it can all be dismissed. Get this, of the $19,000, $12,000 has accured since he got custody. In the original CS order, BM was to provide for health insurance, the order states FH pay $50 extra per month for her to do that. She never did, so there's $1800. In addition to her receiving money to provide the coverage, FH had skids on his employer's insurance to the tune of approximately $3500. That leaves $1700 dollars that is probably mostly interest on the whole mess or part of the back child support he was strapped with and paying $100 a month to get out of when BM first went for CS, but the interest was a killer.

So, since FH has had custody of the kids since last June, and CS is generally retroactive, I think we could safely get $1700 out of BM if we wanted to get CS from her.

Now here's the clincher, BM has been receiving government aid fraudulently since FH got custody. If we take our case to the AG, she'll be looking at criminal charges. ALSO, BM filed her taxes and claimed all of the skids when FH is legally able to do so. If he were to do so, she'd be looking at having the IRS so far up her a$$ for so long, she could probably claim some of THEM as dependents.

Lawyer said we can strike a deal and we're looking at clearing up the entire balance along with the bill of review Friday. I'm so anxious, I'm as jumpy as a road lizard.

Of course, the AG will be looking at getting some money back from BM, but not my problem and we've been more than kind in not screwing her over worse with reporting her for fraud and getting her in dutch with the IRS. Lord, I hope we can do this. I can't wait to get this debt from hanging over our heads especially knowing who it's supposedly owed to.

Of course, we're going to get gypped thousands because we're not going to get to claim the kids on the 2008 tax return. Goodness knows, we could use the money. Also, I'll be denied the pleasure of BM having yet more criminal charges, but I'm willing to let it all go. That's big of me don't ya think????

I guess there is always the possibility that BM will be her usual stupid self and not take the deal.

Please guys, cross your fingers for us!

Yeah that is good of you. I would claim the kids anyway, and when the IRS audits her and you, you will get the refund for them because you have the right to claim them first. And if she is anything like my BM has already spent the money, and will owe the gov. major penalties. These BM's are so money hungry it makes me sick!! Good Luck, but it sounds like you won't need it.

That happened to me before, my ex tried to claim my son on his taxes and I got a letter in the mail and they went after him - what a dumbass. I would not do one thing to make life any easier at all. As a matter of fact I would be a real witch and snitch on her about the govt aid. But that is just how evil I am. Get that return and go get yourself pampered!!!! Don't buy nothing for those kids either!!! We gotta treat ourselves sometimes!!! Smile

But if we don't get this child support crap cleared up, she's just going to get his refund anyway.

See what I'm saying??? So this is a little carrot to dangle before the mule (a$$ more like it) to get that taken care of. I think I'm going to have to let this year's claiming the kids slide in the interest of filing his taxes at ALL. I'm ready to get him in the black as far as CS goes. Then... maybe someday ... I'll hit the bi0tch with paying us CS. muwahahahha
