SO contacting BM's lawyer...allowed or not?

SO has been in pretty close contact with BM's lawyer via email since March when she started this whole "lowering his parenting time" debacle.

Well, since a few days ago when BM started harrassing SO again and stating that she wanted to go to court, SO sent her a lawyer an email saying that mediation went well but that BM and him could not quite come to an agreement and that he would appreciate an update if/when she decided to file to go to court.

BM emailed him today telling him to stop "using" her lawyer and that she was going to bill him for every email he sent. He sent ONE since mediation and her lawyer was more than happy to keep him updated before.

The way I see it is until we actually have to hire a lawyer (when/if she files to go to court) SO is essentially representing himself, so he should have every right to contact her lawyer to see what is going on since BM clearly is trying to be sneaky about things.

what do you guys think? Is he in the wrong? If not, what should he say to BM?

Also, what should SO do when her lawyer no longer contacts him back? He doesn't want to hire an attorney until absolutely necessary and guaranteed even if she files to go to court it will get bumped back down to another referree hearing...
