Child support question?! In Michigan

mangelina81's picture

Is my salary considered in  dh child support? Does joint household income count in Michigan? I'm so sick of friend of the court. Long story...but my husband is layed off from work. And collecting unemployment. I am currently at stay at home mother of 2  and HW. So has this happened to anyone? Does my income make DH child support go up?

You should probably google it, but in most places, I don't believe the spouse's income counts in child support.

Said that your income wouldn't be directly considered, but it could affect the factors used by the judge to calculate CS.  It didn't look like a huge concern, and a spouse's income is not included in the CS formula used in MI.  BUT an attorney will know better than anyone here and better than Google.

My ex got laid off during our time of CS.  We went before a FOC person for a hearing and had our agreement  set up so that if he was laid off again (could have happened with his field) his CS was set at a reduced rate for that laid off amount of time. The judge signed it and it was entered into our file.   That way I still got something and he didn't go into arrearages .  But then again I was a sane BM.  I don't ever remember seeing SM's salary in the paperwork ever,  it was just mine and his.

I don't know what HW is.  Unless you bring in an ungodly amount of money that he doesn't need to work, I wouldn't worry too much about it.  What county are you in?  I also hear that can make a difference regarding the type of workers in the office.  (qualified or not qualified to put it nicely)
