A question, just to make sure

KiFire's picture

Next weekend I'm going to PA with BS, my mother and my brother. I have sole legal and physical custody of BS, his father has no visitation rights, and there is a PO to keep him from contacting us. He hasn't seen BS in close to two years now.

So, do I need to let him know that I'm taking BS out of state? I don't *think* I have to.. but I don't want him to find out and try to do anything.

May want to consult an attorney to be sure but in our state no visitation rights and a po you don't owe them any kind of notice. Down here it can actually backfire and if the custodial parent contacts the one with the po the non custodial can file harassment charges. Just happened to a co worker this week. ( she had a warrant filed for him contacting her but he was just trying to be civil when their daughter had to go to the hospital for a real emergency. She got the upper hand since she was mad that he got full custody over her drug use) they came and picked him up at work!

Well how could he see child with no visitation rights?

I know you are asking something else but sounds to me like he is not In his child's life because he is not allowed to be.

Maybe you have good reason., just sayin, not being allowed to see child would yes, keep him away??
