Got our court date...feeling a little shady about all this. Input please.

So our lawyer finally got his act together and calendared our motion to take away BM's overnights because of her multiple violations. All the details are in my last blog which I would link to if I knew how (someone feel free to tell me how cause after over a year on here I should probably know how to do this).

So anyway, BM has moved again and failed to notify us, which is one of the violations of the order. To put it in her words it's "none of our f*cking business* where she lives. But we have an idea where she lives because the kids showed us the house, so we googled it and came up with a street address. We told our lawyer what we knew, and he said he was going to serve her at the address in the court file which is two houses ago. Our state allows service by mail, as long as you do it x number of days before the hearing.

The problem is that we don't think she'll get it, and then of course won't show up for court. In some ways, this is a dream. She hasn't shown before (because she didn't want to) and the judge gave us whatever we asked for. But there is a part of me that doesn't think it's fair to her. I want the judge to decide based on what he thinks is best based on all the info, and I have little doubt that her being there changes the outcome much.

Maybe I'm just afraid of the backlash. Then she gets to say to the kids, I didn't know we had court, it's your mean daddy's fault.

And of course, we go to court on my birthday. Happy fing Bday to me. Spend all day with BPD/HPD BM and have to see psycho BPD SD21 that night for MY birthday (this is a whole separate blog)

Am I crazy for worrying about this?

Ahhh, the thoughts of never having to deal with her unless she petitions the court. What a pie in the sky dream for us Smile

Secretly I think our lawyer also doesn't want to deal with her in court. She's pro se so he has to deal directly with her. I can't blame him. I need to remember to bring him a bottle of vodka or something, it's what I need after I have to deal with her.

I hear ya. I just hate having to deal with her and still be compared to her, and have her undermining me/DH at the same time. I frequently wait for a giant hole to open up and swallow her up.

Here is another dream that will come true they will reach the age of 18 and then thats the end of having to hear and deal with the ex-wife. I myself cant wait. LOL Blum 3

I used to think that, but now that the oldest is 21 and the others 15 and 16 and the end is in sight, I remember that they're going to get married and have children some day. Ugh!

Not fair to her? Not fair that she is failing to abide by the terms of the CO? Not fair because she choses to not show up in court?

How her is her stupidity not fair to her?

Her stupidity is not fair to her children and to you and your DH. You have to play by the rules, show up in court, etc...

Fry her ass in court and have fun protecting the best interests of your Skids.

I can't abide idiots and barring their asses has become a great source of pleasure for me.

I bared SpermClan idiot ass for nearly 18 years and though it was sad that I had to do it in order to protect my son (SS) from the shallow and poluted end of his gene pool I truly learned to love it.

I think his reasoning is that she should have changed her address with the post office and it should be forwarded to her new address for service. If she didn't and it gets returned, it proves that she's in contempt for not notifying the court/us of her address. This is not the first time he's had to chase her down and I think he's getting tired of it. (she's moved 17 times in 6 years and we're in court 3-6 times per year)
