Update to owed CS court date

I wrote yesterday about the situation of DH owing money to BM of SS20. Here is the link http://steptalk.org/node/96822

DH went to court & showed BM the paperwork that her lawyer sent him yesterday evening. She was appalled that the lawyer was trying to get DH put in jail & have a felony on his record. BM told the lawyer that this is NOT what they had discussed & that he was to drop that from the paperwork or she would be dropping the case all together.

The judge called DH a “stand up guy” because he was not arguing paternity or the fact that he owes money & he has tried to do the right thing as far as his responsibilities by paying what he could. She told him to get his other active CS case modified ASAP.

DH had already agreed to pay BM & the lawyer every month. The judge okayed the amount at less than the monthly obligation until DH is out of school & working. The judge reprimanded the lawyer for A. Trying to ruin a man’s life when he’s trying to better himself, B. Wasting the courts time by insisting that they order automatic payments be taken from his disability funds (IMPOSSIBLE), C. Attempting to use scare tactics against a disabled veteran with blatant disregard for the attempts that he has been making to make good on his obligation, & D. She (the Judge) dropped all criminal charges against DH & told the lawyer that he should be ashamed of himself.

The part that DH found funny was that the judge noticed the age of SS (20), confirmed his age, looked at the lawyer & said "REALLY???"

DH will not be facing jail time & is expected to pay money to the lawyer & to BM each month until his debt is paid in full.

Thanks to those of you who responded with helpful information, words of advice & wisdom on my last post. This has been a horrible couple of days & DH is ecstatic that he got a good judge.

Yay!!!

I'm shocked. This judge is the first I've heard of that didn't lambaste him for not paying what he's ordered to. Go figure.

What state are you in? Maybe I need to move. Smile

Surprisingly, we are in Texas. She saw that it is humanly impossible for him to pay the full amount...I'm surprised she didn't berate him for not having it modified in 2005 (or anywhere inbetween!!!).

I'm so happy they did right by your DH and shamed the lawyer. Your post made my eyes well up with tears. Congrats Insanity.
