Child Support Limbo - Still Waiting
It is now June. BM's lawyer filed with FRO to attempt to get CS for the months that SD18 was in a school program to get her diploma. Per previous posts - CS at the age of 18 and over is to be provided IF SD is in a full time educational program and attending full time. Per the CS agreement with BM, BM needs to provide proof of that the program is full time and DH is to receive attendance records.
SD turned 18 in September which was the last CS payment to BM (per the agreement). BM reached out in November stating that SD had been attending school full time since October and that DH had to pay CS for October and each month moving forward until she graduated. DH did not respond to her but rather went to our lawyer. This began months of due diligence on DH and I's part to get permission to contact the school, discussions with the Vice Principal who confirmed that SD did not attend full time but could attend any time she wanted as it is an alternative program - learn at your own pace. (see previous posts for more details). All of this information provided to BM's lawyer and they still insisted that SD went to school full time and they decided to file with FRO. They filed March 11th. Going on three months and no word. We have heard that it can sometimes take up to 4 months due to back log. Our understanding is that IF FRO determines that it will enforce CS that DH will get notice and then our lawyer will file Motion to Change and a Motion to Refrain. This would then mean we would go to court.
However, we've also learned that IF FRO determines not to enforce, that there is no notice to inform either party of this.
Therefore we wait - continue to be in limbo until at least mid-July. Our lawyer has advised us to wait a bit longer.
In the meantime, should FRO determine that it will not enforce CS, if BM and her lawyer were previously thinking of trying the medical/health route by trying to claim that SD is unable to take care of herself because of back problems...well...that's kind of gone down the shoot...now that SD has herself a job.
So for now...we continue to wait...Sigh...
She needs the CS
For pot payments. Going to school does not mean showing up everyday.[ on line there are college course that are totally on line.
She completed the program. You might owe BM. 6 or 7 months CS

Now that she is 18, her relationship with your side is dependent on her behaving respecfully and reasonably. If she actually graduates, engage with her on any celebration or gift. No interface with BM. Just my thoughts of ocurse.
