A small success at family court!

LuluOnce's picture

The family court meeting was today. BM did show up but she was 110% not medicated. She was not in a psychotic state, but based on what we know of her behavior when she's unwell, it's clear she's getting close again.

She wandered the lobby of the waiting room and gave people her opinion about their cases, saying things like, "Doesn't look good for you. I can tell already." She told DH he looked like shit, kept calling him "dude" and then began some kind of wide arm sun-salutation type movement in the lobby and said to DH, "Let's do yoga, dude."

When they were finally called in, as the social worker began talking, DH said she yelled at him for having a pen in his hand and made the sign of the cross over her chest. The social worker raised her eyebrows and asked BM if she wanted separate interviews. BM said she did, so the social worker escorted BM back into the waiting area and interviewed DH first. He told her everything that I posted previously and went through her past history, explaining that he has no idea what her current diagnosis is (he told her what it had bee in the past), what her medication is, when or if she's taking it, or when she last saw a mental health professional. BM does not tell us and we do not have access to those records and previous COs only required her to get evaluations twice a year. The social worker dismissed DH and called in BM.

We have no idea what was said or what happened but the conclusion is DH retains full legal and physical custody and BM has no visitation at present. It is being referred to private mediation for a "reunification plan" for BM and the kids but obviously, we are not optimistic about that and not even sure how that's a good idea but, for today, this is a small victory.

The court said the SDs had to be available for interview and suggested a care giver be present with them while BM and DH were in the meeting. So they were outside with their grandmother (I did not go). They weren't called in and they did not see BM, which is what they requested. SD12 said after that she is both relieved that she wasn't called in and that they don't have to go back to BM's yet, but that she is really disappointed with her mom. SD7 is perfectly happy and unconcerned with any of this and asked if she could read aloud to her grandma in the car. I am waiting for them to show more signs of intense upset, but so far, they are actually happier and more calm than when they are going between houses.

Not sure when the next meeting will be or what to expect next but for now this is a huge weight off our shoulders and we know the girls are safe, cared for and even mostly happy.

Wow, thank God. You and your husband did good, I celebrate this victory with you!

Very sad for the SDs, you & DH, and for cray-cray BM. Heartbreaking all around, but you two are the rays of hope snd sanity for those girls and I am grateful they have you.

There are so many stories about the courts failing children... I am so glad that this time the kids are actually being taken care of!! The girls are probably so releived that they didn't have to see BM or go back with her that they don't know any other emotion right now. I am sure that will change but embrace the happiness right now!

I honestly will NEVER understand why they try and reunify these people with the kids. She's already done enough damage, let dead ducks lie and call it a day for goodness sake. Then the kids can actually start to heal!!!

I hope the courts realize that BM failing to come forward earlier and then lying about her behavior means she can't be trusted to self report in the best interests of those girls.  I doubt this is the first time she's acted this way, and it went on way longer than it should have.  A local lady stabbed her son to death recently, all the emergency responders knew she would, but the courts here did nothing to stop it.  BM is endangering her kids and she doesn't care.
