Don't think much will change in this neck of the woods however. The old CS Magistrate who is militantly pro BM is retiring. At all the hearings is his successor.

A young militantly pro BM female magistrate. The reign of terror against NCP biodads continues.

In fact at this past hearing that Chef had to go to, she was prompting the BM's attorney. . . are you SUUURRRRREEE your client doesn't want to go for medical as well??!!

Obviously she doesn't know the history of how the BM got away with practically MURDER this past decade. Not that it would probably matter to her anyway.

Good luck to all NYers. I think downstate is probably a little more "with it" than the archaic brined in the "Tender Years Doctrine" upstate family court system.

Got to love this state! When BM2 took DH for more CS last year and DH had his chance to talk and told the magistrate how BM wasn't complaining when she was overpaid for years (due to SSDI $ received for SS15) and how she wasn't complaining when she got over $3,000 in SSDI retro money for SS15.. the magistrate said "well that's all well and good, but she could be getting even MORE from you" Really? Say that right in front of a greedy ass BM? How inappropriate and unprofessional and way to give BM yet another weapon to wield every time she doesn't get what she wants. GEESH!

The paralegal at Chef's attorney's place just started spouting the law. This was the same person who, after reading Chef's story, said he needs a change of venue due to the conflict of interest overtones with the Girhippo actually WORKING for the county there as a CPS/Foster care worker. She also said it *should* be emancipation by conduct.

So the day of the final hearing she said "here's the base amount and he'll probably be ordered to pay medical, too" Which enraged Chef knowing that the Girhippo has been overpaid for the last decade in the interest of "taking the high road." (TM)

ugh!!!

my brother absolutely lucked out - HE is primary, she gets 50% visitation (which she does not always exercise). she cannot move x-distance away. no child support changes hands either. all without an attorney too.

it CAN happen in NY, although it's extremely rare.
