OT-Anyone know anything about car insurance companies?

I was in a car accident on Thursday. It wasn't my fault at all. The lady that hit me ran a red light. They are more than likely going to total my car (it was a 1997 Toyota Rav4). Right now I have a rental, paid for by the ladies insurance.

I have to go back to the doctor on Wednesday because they found blood in my urine. I can't lift my arm left arm very well right now.

What I really need to know is how to NOT get screwed by the insurance company. I still owe money on my car, so whatever the insurance company does pay will go directly to that. If I don't have a car, I will loose my job!

I have looked at the fair market value of my vehicle and it is more than what is listed under Kelly Blue Book.

Any advice you could give me for this situation would be greatly appreciated!!!

I did this a few years back. Let them right off the car and pay you for it. But, I highly recommend before you sign anything, you get a lawyer. I only had a concussion and back problems for a few months. I did physical therapy that they paid for and I settle the claim for an additional 15K after the lawyer got their cut. The lawyer for the girl asked me to drop the case when we went to court for her tickets. I refused and the judge looked at me and said get a lawyer and sue, so I did.

Thanks. My in-laws do some odd jobs for this accident/injury lawyer. I'm meeting with him today to go over some stuff. We'll see how it goes. I have a doctors appointment on Wednesday to recheck my kidneys since they found blood in my urine and to check out my shoulder as well. Ugh...:(

Definitely get an attorney to help you. I was rearended a couple years ago and sandwiched between 2 cars and it really messed up my neck and totalled my car. It was a mess dealing with their insurance company and it took 14 months to settle it. I hope you check out ok!

First of all, get an attorney, secondly, talk to your auto insurance agent ASAP. And finally, whatever you do, don't talk to their insurance company or the authorities without an attorney present. If you slip up and say something wrong, your claim will not be covered for.
