Why is it we have SS13 more then 50% of the time( Sunday thru Friday) and some weekends. BM does not pay any child support. SO provides all medical, dental, vision and BM still get to claim him every other year. It Seems like BS to me. Oh and SS8 We have only 2 Days a week but pay almost 700 a month for and SO never gets to claim him. Stupid system.

He could ask next time they go to court.

Our BM fought to get both skids for her taxes but the courts ordered it split. Even though BM imagined herself quite a genius, she had to have the judge explain to her that splitting the skids would be IN HER BEST INTEREST since she didn't make enough money to take the full benefit and having DH take one of the skids would INCREASE the amount of CS that he paid!

it is BS, but that's the system.

that's why, IMO, child support should be tax deductible for the payor and taxable for the payee. alimony is, why cant support be?

Unfortunately, if they did that, they'd likely just raise the CS amount to compensate. Sad

I-m so happy this is exactly what me and DH were talking about and he said the same exact thing..so as annoying as it is, we just roll with the program. lol

In cases of equal nights a true 50/50 case the tax exemption goes to the higher income parent every time. It says it on the IRS website. DH got it in court due to that law

When SO and BM divorced, they created a separation agreement on their own (well, with the help of SO's lawyer, but not with a judge). They have 50/50 and BM didn't file for CS, but SO pays basically EVERYTHING for the kid. BM had the nerve to suggest alternating years for the tax credit. I turned SO right around and told him that if he is paying pretty much every single expense of this child, he should get the credit. So, his lawyer put it in, BM signed, and he claims the kid every year. Get something in writing for yourselves.
