BM car title in DH's name

After 5 ½ years of being divorced BM still has the car that she drives in DH’s name. On more than one occasion DH has ordered a new title and signed it for her so she can take it to the courthouse to switch it over to her name. She still has not done this. A few months ago DH asked her about it again and she said they needed to talk about that and it never happened, so it’s still in DH’s name.

It bothers me immensely that BM is driving a car in DH’s name and I get the registration for her car in the mail every year. I’ve tried to explain it’s not a good idea to have her driving a car in his name etc, but apparently he doesn’t see an issue with it. What are some repercussions that could possibly happen that I could explain to DH to finally push him to get this taken care of?? I’ve even suggested to him to tell BM that he’s going to junk the title so she can no longer legally drive it if she doesn’t switch it over, but he doesn’t want to do that.

I've suggested he do that or junk the title but he doesn't want to "cause waves" but I want to put a fire under him to want to! That's my concern and I've said he may be liable for certain instances but I'm not sure what.

I've wondered that too, but in all other aspects he's pretty good. They only talk when necessary about SS which is not very often, so I don't know what his issue is.

Because his name is still on the title, he has vicarious liability for the actions of the person driving the car.

This^^^ he does have some liability.

Where I live, if you sign a title over to someone, you have to send in documentation to the state and the person you signed it over to has the responsibility of getting it registered in their name, in a timely fashion (or penalties are applied).

There is just no reason for this.

He has signed it and given it to her to take because I thought the new owner had to file? I may just call the DMV myself and see what can be done other than her taking it up there.

We do not pay insurance, I can only assume BM does as she's been driving it the whole time.

Is she on his insurance or vice versa?? In my state the insurance has to be in the name(s) of whoever is on the registration. Also in my state, there have been cases where in an accident, people have gone after not only the driver, but the vehicle owner (whoever is on the title) Banks actually stopped doing leases for a while because of it, because when you lease a vehicle the title is in the Bank's name as the bank is technically the "owner"

Good lord. Just take the car back until she does what she needs to do. It's as simple as that. If your DH wanted it done it would be done.

I work in PI law and we would absolutely sue your DH if she was involved in an accident causing injury. It would be very ugly if she doesn't carry proper insurance on the vehicle. As registered owner, financial responsibility (insurance) is his burden.

WHat does the CO say -

BM made sure SO will be paying for her vehicle for 5 years, everything.... After 3 years, BM decided seeing I bought a new car she wants one as well and she bought a very very expensive car..... she did not claim the purchase price from SO..... but she did claim new tires, shocks, and engine (yes she bought second hand over prized peace of shit and the engine broke after 3 months)

SO was so stressed about the expense, I pulled out his CO and said - it's very clearly stipulated, you are responsible for expenses on Vehicle XYZ, not ABC, ignore it... BM went to court, paid lawyers fees only to year she broke the CO by selling the car, SO is not responsible for the new car... it's not part of the agreement... I'm still laughing about it..

If your CO says nothing about it, simply go and de-register the vehicle from DH's name... we fill in forms, authorities notify the other person they have 21 days to register the car in their names, if not the car will be scrapped from the roads....

This is a dangerous situation, BM can never pay a fine, be in accidents or what ever and DH will be held responsible.

at least the cow is thinking twice now about going to court with something... she figured I'm not stupid lol...

I swear if it was not for me SO would've paid for the new car and all the repairs.... idiot... how ever BM did sort of send me a message through Aergia saying something like I'm a gold digger and now she has no transport for her babies and she can't even pick Aergia up for visit... I simply replied, she's married her husband can buy a car and well I can drop you off,

I'm not sure, I'll have to check, but they have the worst CO I've seen, hardly any detail at all so I doubt anything about the car.

So DH gives her the signed over title, then he's supposed to mail in the release of liability.

Bm has the signed over title that she needs to bring to the DMV, and since it wasn't done within the allowed time which is like 10 days or something, now has to pay a small fine.

Did DH mail in the release of liability to the state?
