Lawyer going to court?

Dontfeedthetrolls's picture

Question for those of you who have been there.

The paperwork is basically done and now just needs filed If I understand correctly.

I remember from my divorce there was an actual court date but since we weren't fighting and I agreed with everything in the paperwork it was basicly a formality. I didn't have to be there at all.

Now SO is pretty much doing the same. He's agreed to the CO and it's all good. He's waving any sort of appearance in court BUT the lawyer says that he still needs to go. Not my partner but the lawyer.

I don't understand why. The paperwork is done. It's being presented to be signed by the judge. There's no fighting. This is it. I don't believe anything can change. Why does the lawyer need to be there?

To present the final case. Show proof of completion of requirements (example the parenting class), that an agreement between parties has been reached and ask for it's approval.

Routine.

Your So can waive SO's presence and let the lawyer speak for SO, but why not go?

Who is filing the paperwork? If it's not a big deal for him to go, it never hurts to show up. My DH and his BM got in trouble because some paperwork was filed late even though it was turned into the court on time and since it was turned in they didn't go to the court date. If they had they could've explained the mistake and not gotten fines.

Believe me I would make sure I'm there that day... with my lawyer, even if it's just a formality...

you never know what BM might pull on 99...... I would want to make sure all is as we agreed and I want a copy of the divorce documents.

Oh I was for mine. There was no way in hell I was going to not even though we weren't fighting.

SO though doesn't want to. I encouraged him to do so as closure but at this point it's not his intent and I can't make him.

yes you can.... tell him breakfast/lunch is on you and then stop at the court house first...

he can have his meal after

Court is an hour away from our home so that wont work.

Plus I'm not going to force him. This is his divorce not mine. I needed to be at mine for me. If he doesn't want to be at his then that's his choice.

It's about what he wants. The lawyer is going so I'm sure we'll get all the paperwork from him.

My niece's now-ex didn't attend either. His lawyer, of course did. Her ex had just been in town (Friday evening until early Monday morning) as he had to take the parenting class in person (Saturday) and he was in his lawyer's office to finish signing papers and pay his final fees.

Then he boarded a plane for back to his school state the Monday morning of the hearing.
