If a court order says....

Neither parent shall move the residence of the child out of San Diego county without written permission from the other parent or a court order granting the move.

We moved to Japan with full custody of SS with court granted permission and bio mom moved last year out of the county. Does that mean that we have to grant her permission or that she has to get court permission for he summer visitation in Washington state?

Sorry if this is a stupid question but I am still trying to understand all this court stuff. We already bought airplane tickets ($9,000) worth to San Diego because she said that's where she was going to be and now she is trying to say that she is not going to be (with 2 weeks notice) and that we now need to fly him to Washington and we do t want to buy more tickets.

So we are screwed? Also what kind of court order makes the custodial parent pay for plane tickets to visiting parent?

In our experience it was the parent who moved away that had to pay for the visit to ncp for summers/holidays.

If you have documentation of she telling you she'd be in SD, and that's where you send him, that's where she has to pick him up.

I guess it depends. We moved all over and my husband's ex had to pay all transportations cost (the few times she took visitation). I guess if she doesn't pay CS she needs to pay for something.

Why don't you take advantage of a hop to Cali? From Japan it should be simple to get to Travis or the NAS in San Diego.

I have visitors here now that hopped to Dallas from Moron, Spain. Space A is still alive and well, especially in and out of Travis. It is worth a try.

Oh and she can come to San Diego and get him. 2 weeks notice of a change with the child coming from Japan is not reasonable.

The problem with Space A travel is that a 9-year old can't travel alone. So, then SM is carting him with the other kids. That's how many seats? I don't remember if the OP has said how many kids she has. Now, you are looking at a much harder Sp. A spots and just when the schools have let out for the summer. DODEA teachers get first dibs on Sp. A seats going out and coming back in at hte end of the season.

Why wouldn't the dad take the son back to the states? Active duty on leave is the priority Space A status.

I have never heard of DOD teachers hopping back and forth. And I lived overseas for 4+ years, not to mention I was active duty and flew back and forth on a KC 135 where we stopped in Europe on every trip. Please see the DOD regulation below

Here is the criteria for Space A travelers:

Space-A Eligibility

The following types of travelers are authorized to use Space-A airlift. The regulation DoD 4515.13-R contains a complete listing of eligible passengers by category, and the AMC site lists the majority of information you will need to plan your trip. Required documentation for each traveler is also listed below. Please have those documents ready for review when selected for travel:

1. Active Duty Uniformed Services Member (includes National Guard and Reserve members on active duty in excess of 30 days and Cadets and Midshipmen of the U.S. Service Academies): DD Form 2 (Green), US Armed Forces ID Card (Active), Form 2 NOAA (Green), Uniformed Services ID and Privilege Card (Active), or PHS Form 1866-3 (Green), US Public Health Service ID Card (Active), and a valid leave authorization or evidence of pass status.

2. Retired Uniformed Service Members: DD Form 2 (Blue), US Armed Forces ID Card (Retired), DD Form 2 (Blue) NOAA, Uniformed Services ID Card (Retired), or PHS Form 1866-3 (Blue), US Public Health Service ID Card (Retired).

3. National Guard and Reserve Members: Authorized Reserve Component Members (National Guard and Ready Reserve) and members of the Standby Reserve who are on the Active Status List: DD Form 2 (Red), Armed Forces of the United States ID Card (Reserve) and DD Form 1853, Verification of Reserve Status for Travel Eligibility.

4.Retired Reservists Entitled to Retired Pay at Age 60: DD Form 2 (Red) and a notice of retirement eligibility as described in DoD Directive 1200.15. If the automated DD Form 2 (Red) has been issued, the member is registered in his or her service personnel system as a Reserve retiree entitled to retired pay at age 60, and a notice of retirement is not required.

5.Retired Reservists Qualified for Retired Pay: DD Form 2 (Blue), US Armed Forces ID Card (Retired), DD Form 2 (Blue) NOAA, Uniformed Services ID Card (Retired), or PHS Form 1866-3 (Blue), US Public Health Service ID Card (Retired).

6.On Active Duty for 30 Days or Less: DD Form 2 (Red), orders placing the Reservist on active duty, and a valid leave authorization or evidence of pass status.

7. ROTC, Nuclear Power Officer Candidate (NUPOC), and Civil Engineer Corps (CEC) Members: When enrolled in an advanced ROTC, NUPOC, or CEC course or enrolled under the financial assistance program: DD Form 2 (Red) and DD Form 1853.

8.Family Members of Uniformed Services Members: DD Form 1173, United States Uniformed Services Identification and Privilege Card.

9.EML Travelers: EML travel orders issued in accordance with Combatant Command procedures.

10.Disabled and Widows/Widowers: Currently, 100 percent disabled veterans and widows of service members are not eligible to use Space-A travel. (Visit source website)

I know a number of DODEA teachers at the Yokota, Zama, & Yokosuka bases who do. Just to make sure I'm not totally off base I just Facebook-messaged with a friend and she said they just took S-A coming back stateside. Since most Okinawa civilian Space A travel goes through Yokota I would assume the kid would too.

And forgive me if I'm wrong, I though Sewsalot said her husband was deployed, not on this thread but a different one. If I'm wrong, pops LOL, send dad with the kid.

I agree if dad is deployed, then she has no choice but to pay. We never had issues hopping but planes left daily from where we were in Germany to the east coast and my husband was always with us. It was actually a pretty nice perk.

I'm sooooo jealous!!! I want to go to Germany, but for some strange reason the Navy doesn't have any bases :? :O Wink there!!

Anyway, Japan doesn't have as many civilian S-A flights. It used to be weekly and then a few years ago it went to every other week and then to 2x's a month and they only go to Seattle. There are occasionally other flights that you can take, but they aren't civilian flights LOL!

You can go to Rota or Siganella! I love, love, love, Rota-that was my fav place in Europe. I would be super happy when the plane "broke down" in Rota for a week. Nice!!
