how long does the irs take to go after someone who has wrongfully claimed a dependant?

any personal experiences??? anyone here that works for the dpt. of treasury???

oh they read ours QUICK.

we never sent in paper returns in 2014, just did it at the same time as with 2015 - mailed out last wk of Feb, return rcpt stamped as rcv'd 3/1/16.

we just got the ck today for 2014.
BOOOYAHHHHH. and im sure 2015 is soon to follow!!!!

I took just a few months for us. We got a notice in the mail saying we owed more. We had to fight it, that's what took a long time for us. Submitting the exhibits to prove that we were rightful in claiming him.

I guess it all depends. Last year I had to file an amendment after "someone" claimed for BS9. It only took about 6 weeks till I got my refund.

This year luckily I had no issues! Amazing that!

well crap, that's not what i was hoping for... but knowing her luck that's probably what will happen - a big fat nothing. UGH.

how does one go about turning someone in anyway? it's not like they'll confirm to us that it was actually HER that falsely claimed them. i would've thought the conflicting returns would have sent up the red flag, no??

hmmmm, i'll poke around online a bit....

i tried to efile for 2014 and it got rejected stating xxx-xx-1234 has already been claimed. we waited until this tax season and did it again for 2015 - same result, donchaknow! so then i had to file both year's paper returns, along with a copy of the CO and a lovely cover letter on company letterhead detailing exactly WHY no one else has any legal right to claim the kids (all of which i sent return rcpt requested to ensure it got into someBODY's hands). ffw four weeks and i got our refund check for 2014. i'm sure '15 is not far behind.

but i'll see what i can find out for maybe reporting a false claim - i think i have her ss# from her booking intake sheet. }:) }:) }:)

alright echo here's what i found out -

"If someone else claimed your child inappropriately, and if they file first, your return will be rejected if e-filed. You would then need to file a return on paper, claiming the child as appropriate. The IRS will process your return and send you your refund, in the normal time. Shortly (up to a year) thereafter, you'll receive a letter from the IRS, stating that your child was claimed on another return. It will tell you that if you made a mistake to file an amended return and if you didn't make a mistake to do nothing. The other party will get the same letter you did. If one of you doesn't file an amended return, unclaiming the child, the next letter, from the IRS, will require you to provide proof. Be sure to reply in a timely manner.

Winner gets the tax benefits; loser gets to pay the IRS back with penalties and interest."

so they send refunds to BOTH parties, then ask that one side or the other file an ammended return - if neither parent does, they will request further documentation and take action from that.

i bet your skid's bm had to pay back with penalties and you were just not informed about it due to privacy laws - that's my guess. so i bet we'll never know for sure either if dumbass ever gets penalized for this. *sigh*

but either way, that homeless, jobless, meth-addled wh0re is in for a world of financial hurt - dh is still considering going through CSE, plus she's got those felonies still pending, followed by the possible IRS penalties. bwaaahaahaaa }:)

ETA - i'm hoping maybe we get to skip the middle step as the appropriate documentation has already been submitted. *fingers crossed*

This is exactly how it worked for us. We sent in proof and it was handled... but that is verbatim the steps that took place.
