Legal Eagles Alert! How Would You Word This

Chef is now on board with changing the mediation agreement since I explained to him how much it would cost AND he's come to the realization that he wouldn't be able to move out without me "putting him up." I'm actually doing this for ME since less money in his pocket is less money in my pocket and more money for the BM.

I've already added clauses to the Emancipation Event Section such as "shall maintain a GPA of 2.7 etc. for CS to continue past 21. I also defined "other good cause" (to foot drag on getting a post secondary education and postpone employment) as "extreme, fully incapacitating injury or medical emergency"

One of the disturbing clauses under the current Emancipation Event area reads as follows:

Engaging in full-time employment after attaining the age of 18, except and providing that:

-engaging by the child in part-time employment shall not be deemed as an Emancipation Event; however, if the child is employed part-time and is capable of full-time employment, the parties shall re-enter mediation to determine a new support schedule based on the then existing circumstances of the child's capabilities for self-support

I want to tighten this up a bit; possibly imputing income to the child if full time work is possible so that skids don't work part time for the purpose of the BM collecting CS.

He wants to go into business for himself; I told him that would be next to impossible with his current obligation and horrific mediation agreement.

I hope he doesn't forget about wanting his own business before this goes through.

maybe part of his own business could be him buying a little office space somewhere that has a cot in the back room for him to live in...I'll send a hotplate for him to cook on...and come to help you change your locks!

My end goal is for him to buy a fixer upper to call his own. When he was talking about getting out, he looked pretty foolish asking me to put him up in a new mobile home!! This is the same guy who gave absolutely EVERY LAST PENNY to the BM and would NEVER think of asking her for the same thing!!!

I'm thinking we should take up a collection for you to put him up in a place of his own just to get him out of your place...and,really, I will come help you change the locks. I'm only a few hours away! We can have a "ding dong the chef is gone" party! Wink

Of course I have no intention of going into business with him. He'd make a poor business man at best. Yes he's good at what he does, but I'm definitely not doing the business side. I do far and away too much already with all his taxes, paperwork, etc.

It's just another feather in my cap to get him off of my teat by getting the BM off of HIS teat.

thrice - i think i'd try to word it somehow that :
Engaging by the child in part-time employment *shall* be deemed as an Emancipation Event; however, the current support schedule will remain in effect if the child is employed part-time AND is enrolled in post-secondary education with a minimum of "x" number of credit hours per semester and a minimum GPA of "y".'

I did put in "skid shall maintain a 2.7 GPA and 15 credit hours per semester." it's not that OSS couldn't do this, he just is very lazy and wouldn't do it.

With SD and YSS, they are completely lazy and would never even THINK of maintaining a decent GPA or reasonable amount of credit hours beyond maybe 2 per semester.

Chef even suggested that he will not pay for extra curriculars if skid does not maintain a current and previous GPA of 3.0 (I came up with the number since their school district is infamous for dumbing down, grading on a curve and giving froo froo subjects the same weight as the serious ones)
