vacation time question

I have a question about how the vacation time works per the custody order. It says that each parent has 7 consecutive days vacation with SS every year. However, when we are trying to use our vacation time it ends up being longer then the 7 days because of the ways that the normal scheduled days with him. We have him everyone Sunday evening, Monday, Tuesday, Wednesday, and every other Thursday. The vacation we are talking about taking we would leave on Monday and come back the following Monday, however, when we return it is still our days. BM is trying to say that she gets him on our days then because we will have reached our 7 days vacation. We have talked about letting her keep him an extra day before our trip or picking him up 1 day early, but she wants more. Are we required to let her have him on our days, because we have returned from our vacation and the 7 days are up? Or do we still get to keep him because they are our days?

Generally vacation days are in addition to regularly scheduled days. So if when you get back, it is technically your regular days, then no you do not have to let her take him. The same thing will happen when she takes him for 7 consecutive vacation days, so that is where time will be made up.

That is what we are trying to tell her but she is trying to disagree. I know she will miss him but that is why we are trying to give her one extra day. She just doesn't seem to want to listen. Thanks for the info.

We are doing our end of the bargain, we have him 50/50 and still pay her CS (drives me nuts) and my husband has tried to just cave to her at times but I wont let him. He didn't have enough time to set up a pattern with her before I came along, because I started dating him when SS was 6 months so there wasn't much of a chance. She is just trying to cause problems which she did the last time DH tried to take SS out of time and we ended up not being able to take him. It sucked so we are trying to make sure that doesn't happen this time.
