CS Modification hearing today...

Need prayers and/or positive thoughts this morning. DH is finally in court for the CS modification that he applied for almost a year ago. First, the paperwork was lost by CSE. Then, BM's attorney lied to the judge saying that there was a pending case for custody so she could get the court date continued. Hopefully all goes well today and we get the modification.

Good Luck! This is probably the fifth case of "losing" paperwork for a downward mod that I've seen just glancing at these sites a few times a week over the past 7 years or so. I think it is more than coincidence!!!!!

Thanks! Yeah, we're starting to think BM or her attorney has a friend in the CSE office. There have many too many screw ups and shady things happen to be a coincidence. DH has never been late or missed a payment, but they treat him like a deadbeat every time he has to deal with them.

Same here--in my case, when the BM launched a phoney child abuse case against us, they somehow "lost" the findings report that was supposed to be mailed to us so that we could dispute it. They called it a "clerical error." Since we didn't get the findings report in time, they immediately registered Guilty Daddy with the NYS Child Abuse and Maltreatment Register. OH, did I mention that the BM WORKS for CPS/Fostercare??

Holy crap! Was he able to get that fixed? Please tell me she lost her job for filing false reports?

CSE tried to garnish DH's wages once for arrears that he didn't owe. They then sent it to an address he hadn't lived at for a while. We only found out about it because the Payroll supervisor at his work told him. By the time we got it, he had two days left to dispute it. When he went to the CSE office, they tried to tell him he had to make an appointment, and it would be a month from then. Luckily, he refused to leave, and it got straightened out.

Nope she didn't lose her job because Guilty Daddy just rolled over. I spent six months getting it overturned. The down side is that if she had lost her job she would have gone after more CS than she is getting now seeing that her "career" before CPS worker was stay-in-bed mom . .the amount she gets is a WHOPPING amount even though she makes about 10K more than Guilty Daddy.

I'm on another site where the CS is ASTRONOMICAL (NYC) yet somehow, the BM is getting double THAT amount by "accident" via CSE--it's taking almost a year to overturn as well!

As long as you don't live in NY, NJ, MA or CA you have somewhat of a fighting chance.

I'm sure you are aware that the local CSE gets "kickbacks" aka admin fees for every dollar they collect in CS. It's tied in with Title IV-D so it is not in their vested interest, nor the judges, nor any court staff to grant downward mods as they all get a "cut" of CS.
