Court update.

BM called OUR attorney this afternoon to request that the court date be moved further out. Our attorney called DH to see if this was okay. DH told him that under no circumstances does he want the date changed, as BM does not work with us and we have no obligation to use even more money to work with her. So, after BM received this message, she informed our lawyer that she would NOT be in court and there was nothing we could do about it. BM told our lawyer that she was confident that the judge would not make any modifications since she wasn't able to make it. Our attorney is not sure whether or not she will be held in contempt.

I'm not sure what we'll do if she's not and we have to go BACK to court. It was really a stretch for us to throw out that much money to begin with.

I've actually sat in court waiting for our case to be called and seen this happen. They can send out an arrest warrant or make the changes without her there. I saw one father decide not come to court, and the Judge made the changes in favor of the mother. I've also seen when the Judge has asked the father if he would like to have the mother put in jail by the end of the day. I think things really depend on the state and the Judge.

I hope she gets her ass in the slammer }:)

BS3's father didn't show up to our last hearing after almost a year of pre-trial court he skipped all of his supervised visits (no, he didn't have to pay for them, the supervisor was his live-in GF) and then didn't show at Trial. Sooo... I got everything I had been asking for and he can no-longer see BS wihtout going though anger-management and a parenting class on proper discipline(i.e. do not pull your 14m.o. around by his hair or slap him for tossing food on the floor Class). IF he does both of those things, he can petition to remove the protective order and then ask for visitation.

You can ask for attorney fees to be paid by BM since she is obstructing the process and costing you more money.
