Court this morning - sitting around and waiting

Well today is finally the day for the pendente lite hearing, court is at 10 am and there is really no expectation of how it is going to go. The BM and her lawyer still have not responded to anything my bf's lawyer has sent them, so either they aren't going to show up (which would be stupid on their part and BM is dumb, but I don't think she is that dumb) or they are just trying to keep my bf and his lawyer on their toes (most probable).

Is it because court is coming up this week?

As many of you know, the last month has been quite stressful between CPS, police, BM witholding the children from my bf, etc. Well finally, after my bf's lawyer f'ed up again, the pendente lite hearing is this Friday regarding temporary custody of the children. It was supposed to be last Friday, but apparently the county all of the custody/divorce items have been filed is different than his lawyer's usual county (my bf changed lawyer about 3 months back now), so it is 2 weeks between filing for a hearing and the actual hearing, not one week which apparently is normal in VA. 

What do you think BM is going to suggest and how do you think it should be handled?

For all of you who have kept up with the BM situation involving CPS, the custody battle, and the divorce this is an update and also me asking for advice. My bf still has not seen the children, it has offically been 3 weeks (yesterday) since he dropped them off at BM and she has refused to let him see them since. Since my last blog post, my boyfriend has talked to the children on the phone a few times and has also requested to see them to just be denied every time.

New Update: CPS, BM, & Divorce

Unfortunately, this is not a happy update about where things are after about 2 weeks since CPS got involved. So let's start there first, the CPS worker did her home visit on Thursday. She looked around for about 3 minutes and then told my bf there is no evidence of abuse and since her staff meetings are on Thursday mornings, by Friday (this Friday now) that the investigation should be done. Apparently, she reports what she found in her investigation, but it is not her call on whether things are founded or unfounded.

Well, last night we got back from our trip to the beach for my birthday. It was so much fun and so relaxing! Definitely in general was needed after the past week's events. We made a rule we were not to talk about the things going on at all during the trip, just focus on our time together and enjoying the beach. We were very good and followed that except maybe two comments that were made, but it was a one and done sort of comment, we didn't discuss it any further than that.

So an update to what is going on in regards to my bf and the investigation by CPS. Yesterday, the CPS worker did not come by for a home visit, so that will be happening next week instead. The law enforcement officer took my bf's statement over the phone in the morning and then come back around 5 pm to have him write it all down. Afterwards, the officer told my bf the investigation against him as been dropped and they classified it as bruising from the park. So that was good news, in 48 hours, the investigation had been closed against him by law enforcement.

The other blog had so many comments on it so decided to write the new update on the new blog. So those of you who said because there is no formal dates/times were correct. His lawyer said because there is no written agreement or court order, neither parent can be charged with parental kidnapping or witholding, although it does not look good for her to deny him access when CPS has not issued a protective order which they would of done if they were convinced that he abused the children. The more he asks and she denies him access, it will just look worse on her.

So many of you read my post yesterday. Which by the way clearly stated I was looking for advice on CPS, not your opinion on spanking, to be accused of putting my hands on kids that aren't mine (which I never have and never will), or for a break down of everything my bf and/or I are doing wrong. Firstly, the children go to daycare every week day they are not with their mom so usually 4 days a week. They see the youngest full body every day and the oldest they are doing a swim day every Friday and changing out of bathing suits so they are seeing her body as well.

CPS, any advice anyone could provide, please!

Well, today is not a good day. On the 4th of July, we took the children ages 4 and 2 to the park. At this park there is a rock climbing wall on the side of the jungle gym. Sometimes, the children like to climb it and lately have been wanting to on their own. The two year old wanted to do it by herself, which she has done many many times. My bf and I were standing there watching, but not in arms distance as we have been comfortable with them climbing it after doing so successfully so many times. Well, after she was about chest high, she fell off the rock wall and landed on her butt/side.

Both my boyfriend and I have birthdays in July, 12 days apart to be exact, although he is two years older than me. This year for his birthday, I took him yesterday when we did not have the skids on a mountain horse back ride. He has not been on a horse in about 10+ years, but used to have a horse and love to ride. It was so much fun and now we are talking about in the fall doing a half a day right at the same ranch to see all the leaves change. His actual birthday is this week and I have a few gifts to give him and am taking him and the skids out to dinner on the actual day.
