TX Child support sucks! A vent with strong language.

So, DH is always, always, always on time with child support. Never been late. He cuts a check and sends it to the TX child support office every month like clockwork. Well, this month he does it same as usual. Except this month when he gets his paycheck, it's missing several hundred dollars.

Apparently the fucking assholes over at TX child support office decided after YEARS that they were going to deduct it from his pay AND never bothered to inform him, so he's paid child support twice this month.

And no, we can't get our money back from the check we already cut and they cashed.

We're not gonna starve or anything but were definitely going to run our credit cards up. Stupid fucking creeps who can just do anything and never have to explain themselves and my husband has never done anything wrong!

Seriously, the explanation they gave my husband was "the computer did it". No, assholes, the computer just didn't do it. See, the computer is run by this thing called "programming" which is managed by a HUMAN BEING who should be able to say why it happened.

But it doesn't matter anyway, because even if we figured out who did it, there's absolutely no accountability and were not getting our money back, so yeah....

SO...does that mean that because you technically double payed that you can now skip a weeks payment?

No, because it will automatically be deducted from DHs pay. Supposedly, when the SKs turn 18, we'll get a month off the end, but that will depend on their computers recognizing that and terminating the autopsy before SKs turn 18. I'm not holding my breath on that.

Before we got custody of my SD they did that to my husband. They were suppose to take $500 a month out of his paycheck but ended up taking out a total of $1000.00 for one month for ONE child. When we contacted CS they could only tell us that it was suppose to be taken out and if he couldnt afford the $1000 payment then he has to just suck it up, get a lawyer and try to modify the order! Now that we have custody and the mother is $3000.00 plus dollars behind in medical and child support of course the CS office isnt doing anything to her.....

The CS office will NEVER do anything to the BM because they figure out that if the BM doesn't pay, your DH STILL would not qualify for welfare...thus they could care less if she pays or not. Now if he would qualify for welfare, they would be on his ass imputing income. Which of course, goes back to this is not about the kids, but about the states getting their welfare money. Simple.

Ah, I am so sorry. They are indeed a bunch of F#$%ing aholes! Went through something similar with the idiots about 8 years ago...Aholes, we JUST NOW got "credit"...because loser turned 18. No worries, I know it sucks...and yes, believe me, it really does suck because you are right, the aholes will make you run up credit cards, etc. that you were not counting on doing...they could care less.

By the way, if it is any consolation, make sure that you stay on top of cs with them...although we did without because of a similar situation thanks to crazy witch and idiots at CSE years ago, it was hilarious to find out BM was FLIPPING OUT because as far as she was concerned, that money was now hers...she never expected we'd get credit...heck, we didn't either...So CS stopped before it should have been stopped due to the credit from 8 years ago and BM lost it...lol So with all the mess, as pissed off as we were, it was nice to know that BM eventually had to do without cause I can assure you that the last thing she will expect is that you will get credit for it at the end...but again, make sure that you start going to the CSE office and are on their ass about ending CS at least two months before it is scheduled to stop so they can stop it early on her.

Good luck...I don't wish dealing with those people on ANYBODY. In the 8+ years, DH has only dealt with ONE man who was decent to him and one woman who was a bitch but once she met DH and found out he was ahead, etc...was nice...so, good luck.

I don't know how Texas works, but when we overpay CS or they take too much from DH's check, they send him a check back

Texas SUCKS...when THEY make a mistake or YOU make a mistake, it is irrelevant...they "give you credit at the END of the CS order...ie...that could be 18 years later or 2 months later, whenever CS ends..." But if they have already given the BM the money and you do NOT watch them to stop CS early, good luck in ever getting a credit or seeing that money again. You'd have to take the ex to court for that on your own.

My SO had overpaid by $3000 and Ohio didn't send it back to him. They just kept it on the books that he'd overpaid and their plan was to take it off at the end of the CS - unfortunately, he got laid off first so that instead that overpayment allowed him to miss a few months worth of CS before they took it out of his unemployment check.

I feel your pain to an extent. They take my DH tax return every year, whether he is up to date or not. We luckily get the money back a few months later, but it sucks because that's when spring breakup is and we really need the tax return money.

I can't imagine having to wait until the skids turned 18 to get it back, that is still 11 years from now! :S

Actually federal regulations say you should get your money back.

45 CFR 303.100 - Procedures for income withholding. (8) The State must have procedures for promptly refunding to noncustodial parents amounts which have been improperly withheld.

Problem is some states have 'procedures' and other states have decided they are above the law. They know you are unlikely to find a lawyer to take it on so they just violate your property rights with impunity.

Ohio is being sued in a class action for this same issue...Dunlop v ODJFS. Class action in TX? I am not a lawyer and this is not legal advise. Good Luck.
