Couple question about this...
Is it child support or another organization who intercepts the tax return? The reason I ask is because I'm pretty sure they took it, and I'd like to find out for sure, but can't find any info online.
This is a joint return...will they take only DHs' portion of the task return? I know I'm not liable, but I'm wondering if whomever is taking the tax return will split it up between mine and his?

They can take your refund and give it to the ex-wife or ex-husband if back child support is owed. There is a form 8379 that can be filled out so you will still get your portion of your refund. But that form has to be filled out and sent in with your paper tax return. You can not file this form electronically.
We had this happen last year
The first thing to do is to call the I.R.S. They can tell you where your tax return went. IF child support took it then you will be able to get your part back, as long as you worked, and there is a form they will send you to fill out. If child support was the one to take it, you may be looking at 6 months before they separate yours from his. BUT, it only took us 2 months b/c we called them EVERYDAY. (Child Support)

My ex has been very "lax" (to say the least) in paying his child support to me over the years. The State is in charge of my case and I am to receive his Federal and State returns every year....probably for the rest of his natural life since he's behind over $20,000..YIKES!!....and hardly works for a "legitimate" paycheck.
Anyway, when he re-married, I told his new wife....when she asked me....file separately and never put his name on your tax return or they will send it to me. Well, she followed this advice for a few years. For their 2005 taxes, his new wife decided to file Joint/Head of Household in order to get a substantial tax return. Guess What???
I got it. In fact, she called me and asked for it back before I even knew how she filed and that I was actually getting it. I of course told her.....Sorry, I warned you! It was her straw that broke the camels back and shortly after, she finally left my ex as well.
I know there's such a thing as filing "Injured Spouse" to protect you from your DH's debts that may be collected through Income tax refunds. It may be worth checking into in your case but you may have to file an amended tax return in order to get it.

Letter
You should get a letter from the IRS stating where the money went and how much. The state can take the refund for back support. for future, you can file an form as an injured spouse so they don't take your part of the refund.

That really bites the big one!! TY for the tax info though.
I knew we should have just gone through HRBlock. But they wanted $200+!! We had a lot of forms this year, so the price was outrageous, so we left, lol. Thinking now about $200 less, or none at all....*sigh*
